Although multiple sclerosis (MS) is considered to be a disability by the Social Security Administration (SSA), a diagnosis does not necessarily mean an approval for disability benefits. As such, if you are diagnosed with MS, you should consult with a Charlotte disability attorney to see if you qualify for disability benefits.

Some patients who are diagnosed with MS are able to continue working for some time after their diagnosis. On the other hand, many patients find the disease to be completely debilitating and unable to engage in any daily activities and be gainfully employed.

This is the precise reason why the SSA does not automatically award disability benefits on the basis of a diagnosis. Instead, the SSA considers the claimant’s residual functional capacity (RFC) and their ability to perform substantial gainful activity.

Listing Of Impairments

The SSA evaluates disability claims for MS under List of Impairments section 11.09. This listing outlines the qualification criteria needed to satisfy the severity requirement of the listing. Like the other Social Security disability impairment listings, it is difficult to satisfy the severity requirement of a MS impairment listing. As such, it is imperative to hire an experienced Charlotte disability attorney to provide the necessary information the SSA is looking for to award benefits.

However, if the claimant does not meet the listing requirements, he or she may still be approved for disability benefits if they have severe functional limitations that prevent them from being gainfully employed.
