What If I Am Denied Benefits And Do Not Appeal In The Time Limit?

Once you are denied benefits, you have 60 days to appeal the decision. If you do not appeal within that time limit, you must start a new application which may cause you to lose some back benefits. The sooner you appeal, the quicker you will get to the hearing stage and the closer you will be to getting the benefits you need.

How Can I Appeal?

Your denial letter will contain instructions telling you how to appeal your rejection. The first appeal is known as “reconsideration,” which you must request. If you are again denied, you must request an administrative hearing within 60 days.

As a Charlotte disability attorney will tell you, there are three ways you can appeal:

  1. You can call the SSA and arrange for your appeal to be handled by phone and mail.
  2. You can also go to the Social Security office and submit your appeal. Remember to bring a copy of your denial letter and to make sure you leaved with a signed and dated copy of your appeal paper.
  3. Or, you can appeal online at the Social Security Administration website. Make sure you print the receipt for your appeal to prove that you appealed within the 60 day time limit.
